Introduction

Welcome to Tuagye. By accessing or using our platform at tuagye.com, you agree to be bound by these Terms of Service.

These Terms form a legally binding agreement between you and Tuagye, operated by Acloe Technology Ventures.

If you do not agree to these Terms, you should not access or use the platform.

Definitions

In these Terms, the following definitions apply:

Platform refers to the Tuagye website and related services.
User means any person who accesses or uses the platform.
Buyer means a user who initiates a purchase on the platform.
Seller means a user who lists items for sale on the platform.
Transaction means an exchange of goods or services between users.
Verification Period means the time allowed for buyers to verify received items.
Services means all features and functionality provided by Tuagye.

Account Registration

Eligibility

To create and use an account, you must:

Be at least 18 years old.
Provide a valid mobile phone number.
Keep your account information accurate and up to date.
Provide additional verification for transactions over GH₵10,000.
Agree to receive service-related communications.
Keep your login credentials secure.

Account Security

You are responsible for:

Maintaining the confidentiality of your account.
All activity that takes place under your account.
Promptly notifying us about unauthorized access.
Keeping account details current.
Using strong and unique passwords.

Platform Rules

Acceptable Use

When using Tuagye, you agree to:

Provide accurate information about items and services.
Use the platform only for lawful purposes.
Follow our transaction procedures.
Maintain respectful and professional communication.
Complete transactions as agreed.
Record required video evidence for transactions.

Prohibited Activities

You must not:

Use the platform for illegal activity.
Manipulate prices or feedback.
Circumvent the payment system.
Harass or abuse other users.
Submit false or misleading information.
Create multiple accounts to misuse the service.
Sell prohibited items.
Interfere with platform operations.

Transaction Process

Buyer Obligations

As a buyer, you are expected to:

Review item descriptions carefully.
Agree to transaction terms before proceeding.
Make payments through the platform.
Record video evidence when receiving items.
Complete verification within the agreed period.
Report issues promptly and accurately.

Seller Obligations

As a seller, you are expected to:

Provide accurate item descriptions and images.
Record video evidence before shipping.
Ship items as described and agreed.
Respond promptly to buyer inquiries.
Honor agreed prices and terms.
Maintain professional communication.

Verification Period

The verification period follows these rules:

Minimum period: 4 hours.
Standard maximum: 3 days.
Extended maximum for heavy-duty items: 1 week.
The period should be agreed before the transaction.
It can be adjusted by mutual consent.

Payments and Fees

By using Tuagye, you agree to the platform's payment terms and fee structure.

Minimum transaction amount: GH₵50.
A platform fee applies to all transactions.
Fees are non-refundable.
Payments must be made through approved methods.
Funds are held securely until verification is completed.
Additional fees may apply for specific services.

Dispute Resolution

Our dispute process includes the following rules:

All disputes should be reported through the platform.
Video evidence is required from both parties.
Users must cooperate with investigations.
False claims may lead to account termination.
Legal remedies remain available to the parties involved.

Refunds and Cancellations

The refund and cancellation process includes these principles:

Refunds may be issued for confirmed seller misconduct.
Refunds are made only to the original payment method used for the transaction. Tuagye will not refund to a different payment method.
Processing fees, safety fees, and platform fees are non-refundable.
Cancellations must follow platform procedures.
Processing times depend on payment method.
If a product has already been shipped, delivery has been made, or another action has been performed that creates a reasonable cost to Tuagye, we may deduct those costs and issue only a partial refund in line with our internal policies.
Where fraudulent activity is suspected or confirmed, Tuagye may deny refunds, suspend and blacklist the account involved, and require a court order before any withheld funds are released.

Intellectual Property

Platform content and features are protected by intellectual property laws.

Platform content remains the property of Tuagye.
Ownership of user-generated content stays with the user.
Users grant Tuagye a license to use submitted content for platform operations.
Trademarks and logos are protected.
Copyright violations may result in enforcement action.

Limitation of Liability

By using the platform, you acknowledge that Tuagye is not responsible for:

The accuracy of user-generated content.
Direct or indirect damages arising from platform use.
Service interruptions or failures.
Third-party actions or products.
Lost profits or lost data.
Force majeure events or natural disasters.

Account Suspension and Termination

Tuagye reserves the right to:

Suspend, ban, or terminate accounts that violate our policies or Terms.
Remove content that breaches the Terms.
Restrict access to specific features.
Investigate suspicious activity.
Report illegal conduct to the appropriate authorities.
Allow or deny appeals at our discretion, depending on the nature of the violation and whether an appeal route is considered appropriate.

Changes to Terms

We may update these Terms from time to time. Changes take effect when they are posted, and continued use of the platform constitutes acceptance.

Where changes are significant, we may notify users by email or through the platform. Users remain responsible for reviewing updates.

Governing Law

These Terms are governed by the laws of Ghana.

Any disputes are subject to the exclusive jurisdiction of the courts of Ghana, and users agree to submit to that jurisdiction.
